A jury trial allows a group of impartial community members — a “jury of one’s peers” — to hear the evidence and determine guilt or innocence. In California, jurors are ordinary citizens selected at random. Once a party requests a jury trial, the process of jury selection begins.
Jury Selection (Voir Dire)
Jury selection is a critical part of every trial. During this phase, Anahid Agemian and the presiding judge ask potential jurors about their background, opinions, and possible biases. Trial Procedure: The People’s Case vs. the Defense
The prosecution, formally known as The People of the State of California, presents their case first. They must prove the charges beyond a reasonable doubt, using testimony, physical evidence, expert witnesses, and more. After each witness is called, Anahid Agemian may cross-examine to expose weaknesses or inconsistencies in the prosecution’s case.
The Defense is not obligated to present any evidence. However, in most cases, a strong defense includes strategic testimony, expert opinions, and the results of independent investigations. Once the defense presents its case, the prosecution may offer a rebuttal if necessary.
Closing Arguments and Jury Deliberation
After all evidence is submitted, the judge and attorneys agree on a set of jury instructions, which outline the legal standards the jury must apply. Then, each side gives a closing argument, summarizing their position and explaining how the law should apply to the facts of the case.
The jury then retires to deliberate in private. Once they reach a unanimous decision, they deliver a verdict of guilty or not guilty.
